Terms of Service

These Terms of Service govern access to AwaDesk and resident-facing experiences powered by AwaDesk (collectively, the “Services”). By using the Services, you agree to these terms and to any additional rules your residential community provides for its services, spaces, and operations.
1. Service purpose
AwaDesk provides technology that may help residential communities support communications, building-service and maintenance requests, request updates or cancellations, amenity reservations, notifications, and concierge interactions. Features and communication channels vary by community and may change over time.
2. Eligibility and access
You may use the Services only if you are authorized to interact with the applicable residential community and can enter into these terms. You are responsible for information submitted through your access, for keeping any credentials confidential, and for promptly reporting suspected unauthorized use to the community.
3. Acceptable use
You agree not to misuse the Services. In particular, you must not:
- submit information you know is false, unlawful, threatening, or infringing;
- impersonate another person or misrepresent your authority;
- attempt to bypass access controls, probe security, disrupt operations, or introduce malicious code;
- use automated methods to scrape or overload the Services; or
- use the Services in a way that violates law or another person's rights.
Access may be limited or suspended when reasonably necessary to protect residents, communities, or the Services.
4. Resident and community interactions
AwaDesk supplies technology; the applicable property or community remains responsible for its personnel, decisions, amenities, building work, policies, response times, and resident relationships. Submitting a request does not guarantee that it will be accepted, completed, or completed within a particular time. Reservation availability and rules are set by the applicable community.
5. Messaging and calls
If you use a messaging or telephone feature offered by your community, you authorize processing of the communications needed to provide that interaction. Message frequency may vary, and message and data rates may apply. Where supported, reply STOP to request that text messages cease or HELP for assistance. Automated or AI-assisted systems may participate in concierge interactions; their output can be incomplete or mistaken and should not be relied on for emergencies or other critical decisions.
6. Emergencies
AwaDesk and AwaDesk-powered concierge services are not emergency-response services. Call 911 or the appropriate emergency service for immediate threats to life, fire, suspected gas emergencies, serious medical emergencies, or similar urgent situations. Do not wait for a response through AwaDesk.
7. Third-party services
The Services may rely on or link to third-party services, including communications and hosting providers. Those services may have separate terms and privacy practices. AwaDesk is not responsible for third-party websites, services, content, or acts outside its control.
8. Availability and changes
AwaDesk may add, modify, limit, or discontinue features. Services may sometimes be unavailable because of maintenance, technical issues, provider outages, community decisions, or circumstances outside reasonable control. No uninterrupted availability or particular response time is promised.
9. Intellectual property
AwaDesk and its software, design, branding, and content are protected by intellectual-property laws. These terms allow you a limited, personal, non-exclusive, non-transferable right to use the Services for their intended purpose. They do not transfer ownership. You retain rights in content you submit and permit its use as reasonably needed to provide, secure, and improve the Services.
10. Disclaimers
To the extent permitted by law, the Services are provided “as is” and “as available.” AwaDesk disclaims implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. AwaDesk does not warrant that information, automated assistance, request routing, or community-provided content will always be accurate, complete, or timely. Some jurisdictions do not allow certain disclaimers, so parts of this section may not apply to you.
11. Limitation of liability
To the extent permitted by law, AwaDesk will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, use, or goodwill arising from the Services. AwaDesk's aggregate liability arising from the Services will not exceed the greater of the amount you paid directly to AwaDesk for the Services during the 12 months before the claim or US $100. These limits do not apply where liability cannot lawfully be limited.
12. Changes to these terms
These terms may be updated as the Services develop. The effective date above will be updated when revised terms are published. Continued use after updated terms take effect means you accept them, to the extent allowed by law. If you do not agree, stop using the Services.
13. Questions
For questions about a particular request, reservation, message, or property policy, contact the residential community offering the AwaDesk-powered experience using the contact method it provides. A general AwaDesk contact channel will be added here when one is verified and available.
